Privacy Policy
When you use our booking form, we collect your name, email, phone number (optional), preferred package, date, and message. We use this data solely to respond to your inquiry. Our hosting provider (Hostinger) automatically collects technical data such as IP address and browser type for website security.
We process your data based on your consent (Art. 6(1)(a) GDPR), contract performance (Art. 6(1)(b) GDPR), and legitimate interest for website operation (Art. 6(1)(f) GDPR). Inquiry data is stored for up to 6 months, or up to 3 years for confirmed bookings. Invoice data is retained for 10 years per German tax law.
You have the right to access, correct, delete, or restrict the processing of your data at any time. Contact: gunay@omayphotography.com. Complaints may be directed to the Berlin Commissioner for Data Protection (datenschutz-berlin.de).
We do not use advertising cookies. The third-party services described below may set cookies; where consent is required, they load only after you accept them via our cookie banner. Social media links on our site are simple links — no data is shared until you click them.
We use the Wordfence security plugin to protect this website from unauthorized access. Wordfence may process your IP address and transmit it to servers operated by Defiant Inc. (USA) for threat detection. This is based on our legitimate interest in website security (Art. 6(1)(f) GDPR). Defiant Inc. is certified under the EU-US Data Privacy Framework.
We use Google Analytics (via the Google Site Kit plugin) to understand how visitors use our website. With your consent, Google LLC (USA) may set analytics cookies and process data such as your IP address and usage behaviour. We rely on your consent for this (Art. 6(1)(a) GDPR) and load it only after you accept analytics in our cookie banner; you can decline or withdraw at any time. Our contact page uses Google reCAPTCHA v3 to protect against spam. It loads when you open the page (not only on submit), and data such as your IP address and browsing behaviour is sent to Google LLC (USA); it also sets the _GRECAPTCHA cookie. Photo Rights
All photographs are protected by German copyright law (UrhG). Clients receive a license for private, non-commercial use only. Editing, filtering, or commercial use requires written consent.
With your explicit consent in the booking form, we may use selected images for our portfolio and social media. You can withdraw this consent anytime — images will be removed within 14 business days. Without consent, your photos remain private. For minors, parental consent is required.
Terms & Conditions
Booking: A form inquiry is not a binding contract. Bookings are confirmed via email. A 20% non-refundable deposit may be required.
Payment: Due on the day of the session. Listed prices are starting prices and may vary.
Cancellation: More than 14 days before — full refund minus deposit. Within 14 days — no refund, one reschedule possible. Photographer cancellation — full refund or free reschedule. Bad weather (outdoor) — free reschedule.
Delivery: Edited photos via online gallery, typically 1–2 weeks (standard) or 2–3 weeks (weddings). RAW files are not provided.
Liability: Limited to the amount paid. No liability for force majeure.
Governing law: Federal Republic of Germany.
